The workers’ compensation system provides benefits to people who have been injured on the job. Although many workers’ compensation claims relate to incidents such as broken bones, machinery accidents, and other singular events, claims can be filed for any injury that is work-related. This includes cases in which a person’s job aggravates a pre-existing condition.Filing a claim related to a pre-existing condition can be more difficult than a typical workers’ compensation claim. In many of these cases, employers and their insurance companies attempt to downplay the severity of an injury or deny an injury’s work relation because of its association with a pre-existing condition. They may claim that because your injury existed previously, you are lying about its work relation to receive benefits.

Conditions worsened by workplace exposure or repeated job duties may qualify as occupational illnesses under Florida workers’ compensation law. An experienced occupational illness lawyer in Orlando can help prove the connection between your work and your condition, challenge employer pushback, and fight for the benefits you deserve.

When facing these hurdles to your workers’ compensation claim, it is important to remember that people whose work aggravated a pre-existing condition are entitled to benefits. You will need to concretely establish the link between your job and the aggravation of the injury. At Van Dingenen Law, our Sanford workers’ compensation attorneys can help you do this. We can defend your rights throughout the workers’ compensation claim process and enlist the help of qualified medical experts to demonstrate the occupational link to your employer and their insurance company, if necessary.

Workers’ Compensation Statute of Limitations in Florida

When filing a workers’ compensation claim for a pre-existing condition, it is important to keep the statute of limitations in mind. Work injuries associated with pre-existing conditions are often repetitive strain injuries, or injuries caused by tedious, repeated motion such as typing. Unlike injuries that can be linked to a single incident, the timeline of these types of injuries can rarely be pinpointed.

The statute of limitations on workers’ compensation claims is 2 years following the date of injury. If your injury developed over a long period of time and cannot be linked to a singular accident, the statute of limitations begins once you realize that your job was the cause of your injury. Your employer and their insurance company may attempt to devalue your claim by alleging that you filed it outside of the statute of limitations. Again, the input of a medical expert and the guidance of our skilled legal team can help you establish the timeline of your injury and the viability of your workers’ compensation claim.

The Van Dingenen Law legal team specializes in workers’ compensation law. We are available to discuss your work injury questions during a no-cost case evaluation.

I suffered some herniated discs, pinched nerves, and other injuries at work. Don, Blaze, Alexa, Brandon, and the other staff I spoke with were all fantastic! Can’t recommend highly enough! They worked hard and made sure I received everything I could or was entitled to under the law. Thanks so much to everyone at Van Dingenen Law!

I fractured my foot at work and was denied Workman’s Comp completely. They did not cover any costs at all. I contacted Van Dingenen Law and they were able to see me the very next day. I met with attorney Blaze Schwartz who read the documents and told me not to worry that I had a strong case and he would help. Thanks to Blaze I was compensated for worked missed and all out of pocket medical. I truly would recommend this firm to anyone in need of representation. Again thank you Blaze and your entire team at Van Dingenen Law.

After 20+yrs I lost my job because of an injury, I first contacted a large law firm and was told that they could not do anything for me even though they advertise as being the largest of all. I then contacted Van Dingenen law who took up my case with the same scenario and got me a substantial settlement. I guess largest does not equate to being the Best. From beginning to the end it was a smooth no hassle process all in a much sooner time than I anticipated. Words can’t express my gratitude and appreciation for the outcome, meeting Mr. Van Dingenen himself was such a pleasant and reassuring moment that I knew then if anybody could it would be him. I never give anyone a rating as this, but hands down they are well deserving of this. Thanks, and God Bless. You are the Best.

I was injured at work and was referred to this law firm by a friend. I’m so glad I contacted them. Van Dingenen and his staff could not have been more helpful and I am very grateful for them helping me through the stressful work compensation process. They were able to beat the insurance company and help me win my case. I was not even sure I had a case until they assured me they could help. All the staff were professional and nice. Very good experience overall.

I made an appointment after I felt like my best medical issues were not being attended to…I felt like I was not being heard. I was extremely impressed on the first visit. Immediately they became my voice and very quickly I could see the difference in how things were happening. The communication was always there and they always got back to me. Mr Van Dingenen always worked personally with me at each meeting and in the end I was more than satisfied with my outcome . If you have questions or concerns I would HIGHLY recommend Van Dingenen Law to anyone who has issues with workers comp.

Although we had some communication issues at the beginning, which turn out to be a misunderstanding between both myself and the office, the issue was rectified quickly and things got back on track. I was a little hesitant to hire a lawyer but the reputation Van Dingenen has, and even though our little hiccup, everyone made me feel like part of the family, if I ever had any confusion or needed things explained Donald himself would call me and straighten things out.. Even in these uncertain times my team was right there when I had questions, and they were on top of the other party to make sure everything was done that needed to be and in a timely manner. If I was to ever need a workers comp lawyer I would gladly call Van Dingenen Law again and again. From the consultation to close, my team made everything smooth and I greatly appreciate it. Donald, Blaze and the great team at V.D. Law, thank you again for helping me and my family get through this rough time.

I would like to give a big thank you to Mr Van Dingenen, Blaze and all of his staff. Everyone was very welcoming and treated me as a person and not just another number. I was always given updates on my case and when I did call or email, I was contacted with a response. If anyone needs a lawyer to represent them, this who you should call. Bigger firms just don’t do it. Thank you.
